Difference Between Lawful and Unlawful Discrimination

The word discrimination means ‘distinguish’ or ‘distinction to be made’. Let us discuss in detail about it. What is the difference between unlawful and lawful discrimination. All types of discrimination will not violate the laws of state or federal laws. There are certain types of treatment which are unequal, are referred as legal. Let us consider an example. A person wants to rent a house in an apartment. But he owns a dog. At the time of signing the agreement, the owner of the house rejects him and says he will not leave the house for a person who owns a pet. Here the house owner has not violated any civil rights against the person. Some people would not know what the difference between unlawful and lawful discrimination is. Under certain circumstances, the discrimination is lawful, to restrict some services by specific group or groups. It is unlawful to treat the physically challenged person less favorable compared to other persons for the reason of their disability. Discrimination in some forms such as sex, religion, race, which also includes sexual orientation are said to be lawful in some circumstances.

 

There are two types of unlawful discrimination, discrimination by treatment which is unfair and treating the disabled person with some disadvantageous acts. There are two types’ direct discrimination and indirect discrimination. In direct discrimination is where you treat a disabled customer less favorable than others while the indirect discrimination is where you require a disabled person to comply the requirement to be completed. Hence this is what the difference between unlawful and lawful discrimination.
